Welcome to LVL Lendr, a web application operated by Crafty Codr Inc. (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website and services. By accessing or using LVL Lendr (the “Service”), you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you disagree with any part of the Terms, you must stop using the Service immediately.

2. Eligibility and Account Registration

Minimum Age: You must be at least 13 years old to use LVL Lendr.
Account Creation: In order to access and use our Service, you are required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We strongly recommend that you do not share your login information with others.
Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.

3. Permitted Use and Prohibited Conduct

LVL Lendr is intended solely for personal use in trading and lending video games with others.

Post fraudulent or misleading listings.
Engage in harassment, abusive behavior, or any other conduct that may harm other users.
Upload or share copyrighted materials without obtaining the necessary permissions.
Use the Service in any way that violates any applicable law or regulation.

Failure to comply with these rules may result in the immediate suspension or termination of your account.

4. User-Generated Content

Content Uploads: Users may upload content, including images, descriptions, and other data related to video games. Image content is stored on AWS S3, and additional data is maintained in our databases.
Ownership and License: You retain all rights to any content you upload. However, by uploading content, you grant LVL Lendr a non-exclusive, worldwide, royalty-free license to display, reproduce, modify, and distribute your content solely for the purpose of providing the Service.
Content Disputes: LVL Lendr reserves the right to remove any content that violates these Terms or is subject to valid legal complaints.

5. Payment and Transaction Terms

Payment Processing: While LVL Lendr does not currently process payments, we plan to integrate with third-party payment processors (e.g., Stripe) in the future. All payment processing will be governed by the respective third party's terms and conditions.
User Disputes: LVL Lendr does not mediate or manage disputes between users regarding trades. It is the responsibility of the users to resolve any disputes that may arise from transactions or trading activities.

6. Intellectual Property

Platform Ownership: The LVL Lendr platform, including its design, text, graphics, and software, is protected by copyright and other intellectual property laws and is owned by Crafty Codr Inc.
User Content: While you retain ownership of your user-generated content, any disputes regarding intellectual property may be resolved by removing the disputed content from the Service.

7. Termination and Suspension

Termination Rights: We reserve the right to suspend or terminate your account immediately and without prior notice for any violations of these Terms, including but not limited to fraud, harassment, or other prohibited activities.
Effects of Termination: Upon termination, your right to access or use the Service will cease immediately. All provisions of these Terms that are intended to survive termination shall remain in effect.

8. Disclaimers and Limitation of Liability

Disclaimer of Warranties: The Service is provided “as is” and “as available” without any warranties of any kind. LVL Lendr expressly disclaims any warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: In no event shall LVL Lendr, its affiliates, or Crafty Codr Inc. be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

9. Dispute Resolution

User Disputes: Any disputes arising between users are to be resolved directly between the parties involved.
Disputes with LVL Lendr: In the event of any dispute between you and LVL Lendr, you agree to attempt to resolve the matter through mediation before initiating any legal proceedings.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of laws principles.

10. Modifications to the Terms

Right to Modify: We reserve the right to modify these Terms at any time. Any changes will be communicated to you via the email address associated with your account.
Continued Use: Your continued use of the Service after changes have been made constitutes your acceptance of the new Terms.

11. Third-Party Links and Integrations

Social Sign-In and Third-Party Services: Our Service may offer social sign-in options (such as Google authentication) and include links to third-party websites or services. Use of such services is subject to the terms and conditions of those third parties.
No Endorsement: Inclusion of third-party links or services does not imply endorsement or control by LVL Lendr over those services.

12. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and LVL Lendr regarding your use of the Service and supersede any prior agreements or understandings.
